By accessing and using Wizeware's n8n automation platform services ("Services"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these Terms of Service, please do not use our Services.

2. Service Description

Wizeware provides workflow automation services through the n8n platform, enabling users to create, execute, and manage automated workflows and integrations with various third-party applications and services.

3. User Account and Registration

To use our Services, you must:

• Create an account with accurate and complete information
• Maintain the security of your account credentials
• Be at least 18 years of age or have parental consent
• Notify us immediately of any unauthorized account access
• Be responsible for all activities under your account

4. Acceptable Use Policy

You agree NOT to use our Services to:

• Violate any applicable laws, regulations, or third-party rights
• Transmit malware, viruses, or harmful code
• Attempt to gain unauthorized access to our systems or other users' data
• Interfere with or disrupt the integrity or performance of our Services
• Use the Services for any illegal, harmful, or abusive purposes
• Scrape, harvest, or collect data without authorization
• Impersonate any person or entity
• Overload our infrastructure with excessive API calls or workflow executions

5. Intellectual Property Rights

You retain ownership of the workflows and data you create using our Services. However, you grant us a license to host, store, and process your content as necessary to provide the Services. The n8n platform, documentation, and related materials are protected by intellectual property laws.

6. Third-Party Integrations

Our Services allow integration with third-party applications. We are not responsible for:

• The availability, functionality, or content of third-party services
• Any data exchange between you and third-party services
• Third-party terms of service or privacy policies
• Any issues arising from third-party integrations

7. Service Availability and Support

While we strive to maintain 99.9% uptime, we do not guarantee uninterrupted service. We reserve the right to:

• Perform scheduled maintenance with advance notice
• Make emergency updates or repairs
• Modify or discontinue features with reasonable notice
• Suspend services for violations of these Terms

8. Data and Privacy

Your use of our Services is also governed by our Privacy Policy. We implement security measures to protect your data but cannot guarantee absolute security. You are responsible for backing up your critical workflows and data.

9. Fees and Payment

If applicable, you agree to pay all fees associated with your subscription plan. Fees are non-refundable except as required by law. We reserve the right to modify pricing with 30 days' notice.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Services are provided "AS IS" without warranties of any kind
• We are not liable for any indirect, incidental, or consequential damages
• Our total liability shall not exceed the amount paid by you in the past 12 months
• We are not responsible for data loss, business interruption, or workflow failures

11. Indemnification

You agree to indemnify and hold Wizeware harmless from any claims, damages, or expenses arising from your use of the Services, violation of these Terms, or infringement of any third-party rights.

12. Termination

We may terminate or suspend your account immediately if you:

• Violate these Terms of Service
• Engage in fraudulent or illegal activities
• Fail to pay applicable fees
• Abuse our Services or infrastructure

Upon termination, your right to use the Services ceases immediately. You may export your data within 30 days of termination.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or platform notification. Continued use after changes constitutes acceptance of the new Terms.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of Canada. Any disputes shall be resolved through binding arbitration in accordance with Canadian arbitration rules, except where prohibited by law.

15. Miscellaneous

• Entire Agreement: These Terms constitute the entire agreement between you and Wizeware
• Severability: If any provision is found invalid, the remaining provisions remain in effect
• No Waiver: Failure to enforce any provision does not constitute a waiver
• Assignment: You may not assign these Terms without our consent
